Our Liability Waiver

theWALK™ Release and Waiver of Liability

You should read this. You’ll be asked to sign off on it when you book your tour, and won’t be able to start the tour without signing it.

I acknowledge and agree to participate in this program/event under the following terms:

General Provisions. I understand that this waiver discharges KRIOS CONSULTING, LLC - DBA THEWALK (the “Company”) from any liability or claim that I, the Participant, may have against the Company with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation on the Company's work site. I also fully understand that the Company does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage.

I, the Participant, understand that I expressly waive any such claim for compensation or liability on the part of the Company beyond what may be offered freely by the representative of the Company in the event of such injury or medical expense.

Voluntary Participation. I understand and confirm that my participation in a the Company walking tour is voluntary. I am in good health and suffer from no physical or mental condition that would make me susceptible to injury or disability while participating in the tour.

Understanding Risks. I am aware of the risks, dangers, and hazards involved in my participation in the Company walking tour. I understand that the Company walking tours take place in public venues under conditions largely beyond the control of the Company walk leaders and the Company. Potential risks may include, but are not limited to, uneven walking surfaces, potholes, raised path edges, wet or slippery ground, steps, curbs, low lighting, narrow walkways, traffic movement, road crossings, diversions due to construction, or exposure to weather conditions.

Assuming Risks. I, the Participant, release and hold harmless the Company and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from participation in this event/program with the Company assume all risks involved in participation in a walking tour provided by the Company. I accept personal responsibility for any liability, injury, loss, or damage in any way connected with my participation in the Company walking tour.

I understand that my time with the Company may include various activities that may be hazardous to me and may include exposure to slippery and uneven terrain, river crossing, stinging and biting insects, poison ivy, encounters with wildlife, and inclement weather. Any other risks associated with being outdoors and on or near waterways may also be inherent in activities. I hereby expressly and specifically assume the risk of injury or harm in these activities and release the Company from all liability for injury, illness, death, or property damage resulting from the activities of my time with the Company.

Release of Liability. I release, waive, discharge and covenant not to sue the Company, its principals, affiliated entities, parent companies, subsidiaries, present and former employees, owners, officers, members, managers, partners, contractors, insurers, shareholders, and directors (collectively “Released Entities”) from any and all claims, actions, damages, liabilities, losses, costs, and expenses for death, injury, loss or damage of property, in any way arising out of my participation in a Stroll walking tour, including, without limitation, any and all claims resulting from the negligence of the Released Entities.

Indemnity Agreement. I indemnify and hold harmless the Released Entities from any loss, liability, damage or cost that they may incur for losses and damages which may be brought against me or against any of them by anyone claiming to be injured (including death) or whose property is damaged as a result of my actions arising from or during a Stroll walking tour.

I expressly agree that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Michigan in the United States of America, and that this waiver shall be governed by and interpreted in accordance with the laws of the State of Michigan. I agree that in the event that any clause or provision of this waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to enforceable.

Consent to Medical Treatment. I hereby release the Company from any claim whatsoever which arises or may arise in the future on account of any first aid treatment or other medical services that are conducted in connection with an emergency during my time with the Company. I authorize the Company to provide me with customary medical assistance, transportation, and emergency medical services as the result of injury or health condition. This consent does not impose a duty upon the Company to provide such assistance, transportation, or services. I have the right to refuse medical assistance and understand the Company will provide assistance if I am incapacitated.

Promotion Release. I agree to grant to the Company a royalty-free license to use my photographic, video, or digital likeness, in whole or in part, taken during a tour, solely for promotional, educational, and/or the Company purposes.
